How to Buy Property in North Cyprus: 2026 Step-by-Step Guide
How to buy property in North Cyprus (the Turkish Republic of Northern Cyprus, TRNC) comes down to a fixed legal sequence: a stamped sale agreement, registration of that agreement at the district Land Registry and a purchase-permit application within one month, a Council of Ministers permit published in the Resmi Gazete, payment of Land Registry fees within a set number of working days, and signature of the transfer at the Land Registry. This guide describes that sequence as of 24 October 2026, with the deadline, the office, the documents and the cost at each step.
Readers working out how to buy property in North Cyprus will also find here how the sequence differs for a completed home and for an off-plan home, worked examples in pounds sterling built from prices on our own listing pages, a document checklist, the mistakes that the rules make easy, and answers to the questions buyers ask most often. Two rules in it are time-limited: the purchase limits come from Decree-Law 89/2026, a Council of Ministers decree whose 90-day validity ends about 5 November 2026 unless Parliament enacts it, and the Land Registry fee schedule is valid only to 5 January 2027. Where a figure is a calculation rather than a published number, the text says so.

The rest of this guide expands each row. For the question of who is allowed to buy and in what numbers, the companion piece on whether foreigners can buy property in North Cyprus goes into the eligibility rules in more depth, and the piece on North Cyprus property taxes and fees covers the ownership and resale taxes that follow a purchase.
Who Can Buy and How Much: The Limits That Shape Every Purchase
Before the sequence begins, the buyer has to know whether the intended purchase fits within the law. Law 52/2008 on the acquisition of immovable property by foreigners (consolidated text on mevzuat.gov.ct.tr) lets a foreign person acquire property by purchase only with a purchase permit from the Council of Ministers. A foreigner, for this purpose, is anyone who is not a TRNC citizen. A company counts as foreign if it has any foreign shareholding or a majority of foreign directors, and a trustee acting for a foreigner is treated as a foreigner.
The numerical limits are where the sources differ. The limits currently applied come from Decree-Law 89/2026, published in Resmi Gazete No. 147 on 7 August 2026. It re-issues Decree-Law 63/2026 (Resmi Gazete No. 87, 11 May 2026), whose 90-day validity ended on 10 August 2026. Press coverage by Bugün Kıbrıs reported the re-issue, and the government’s stated reason was that Parliament was in recess and could not enact the amendments its committee had begun to discuss. A decree of this kind applies for as long as it remains in force; counted from 7 August 2026, 90 days end about 5 November 2026 unless Parliament enacts the text. The consolidated Law 52/2008 on mevzuat.gov.ct.tr has not been updated to reflect the decree and still shows the stricter text introduced by Law 39/2024.
| Limit | Decree-Law 89/2026 (while in force) | Consolidated Law 52/2008 text on mevzuat.gov.ct.tr |
|---|---|---|
| Apartments | Up to 3; up to 6 for nationals of states that recognise the TRNC | 1; 3 for nationals of recognising states |
| Land with a permitted building | Up to 1,338 m2, one house only | 1,338 m2 with one house |
| Detached house | On land of up to 3,300 m2, with no second house or apartment on that land | On land of up to 3,300 m2 |
| Villas in a mass-housing project | 2 two-storey detached villas; 3 for nationals of recognising states | One property per foreigner |
| Deadline to transfer title after the permit is published | 1 year | 6 months |
| Deadline to pay transfer fees after publication | 75 working days | 60 working days |
| Investment purchases by companies | EUR 10,000,000 minimum | EUR 20,000,000 minimum |
Several limits sit outside that table and apply on both texts. No agricultural land or forest land may be sold to foreigners, and foreigners may not acquire property in first-degree military prohibited zones or military security zones. Foreigners may not hold more than 7% of the area of any district or more than 3% of the area of the country, and an entry made in breach is void. A foreigner cannot buy a share title (hisse koçanı) in land; for an apartment or detached house, a share title may be held jointly by at most three foreign natural persons. The decree adds that sales of a housing project in a zoned area are capped at 80% to foreigners, and that foreigners who are first-degree relatives or of the same nationality may not together buy more than half of the units on one parcel.
The consequence for the order of events is practical. A contract signed now should state which limit the lawyer relied on and what happens if the decree lapses before the permit is decided, because a purchase that fits the decree’s limit but not the consolidated text is exposed to that change. The sibling guide on the comparison of North and South Cyprus property rules shows how the Republic of Cyprus handles the same question for non-EU buyers.
How to Buy Property in North Cyprus Step by Step: The Ten-Step Sequence
The table lists the steps in the order in which the law and the Land Registry notices place them. It shows who acts at each step, what is filed, the time limit where one exists, and the cost. Steps 1 and 2 are checks rather than filings, and they come first because a defect found after the one-month clock has started leaves little time to react.
| Step | What happens | Who acts | Documents | Time limit | Cost |
|---|---|---|---|---|---|
| 1 | Ownership search on the unit and parcel | Buyer or lawyer at the district Tapu Amirliği | Title details, parcel number | None set | Land Registry office fee |
| 2 | Check condominium title or easement, permits and title category | Lawyer | Kat mülkiyeti or kat irtifakı record, building permit, final approval where completed | Before the permit application | Lawyer’s fee (no official tariff) |
| 3 | Reservation and sale agreement signed | Buyer and seller or developer | Passport, agreement, payment schedule | Starts the one-month clock for step 5 | Deposit as agreed |
| 4 | Agreement stamped at the Tax Department | Buyer or representative | Signed agreement | Before registration | Stamp duty 0.5% of the sum |
| 5 | Agreement registered at the Land Registry and permit application lodged with the Interior Ministry | Buyer in person, by proxy or through a lawyer | Stamped agreement, application file | 1 month; otherwise the contract is void automatically | Taxes and fees due on the sale; application fee TL 35,446.50 |
| 6 | Review and security inquiry; Council of Ministers decision | Interior Ministry and Council of Ministers | Police record, forms, location plan | No period set in the law | See the application fee in step 5 |
| 7 | Permit published in the Resmi Gazete | Government | None | Starts the transfer clocks | None |
| 8 | Land Registry transfer fees paid | Buyer and seller, as the legislation allocates them | Fee receipts | 75 working days (60 in the consolidated text) | 4% / 5.5% / 6% of the sale value |
| 9 | Transfer declaration signed and title registered | Buyer and seller before the Tapu official | Printed transfer declaration (devir takrirnamesi) | 1 year (6 months in the consolidated text) | Covered by the fees paid in step 8 |
| 10 | Utilities connected in the buyer’s name | Buyer with the water and electricity authorities | Proof that taxes and fees are paid | After step 8 | No official connection tariff |
Step 1: the ownership search
The Land Registry (Tapu ve Kadastro Dairesi) lists an “araştırma belgesi”, an information-only ownership query, among the services handled at the district office. A notice of 15 July 2025 adds that, during the roll-out of the Web Tapu and TAKBİS automation, transfers, mortgages, research documents and file transactions are handled only at the Tapu Amirliği of the district where the property is registered. A unit is therefore searched at the office of its own district, for example Famagusta for a Famagusta unit. An agency guide to title due diligence says the search shows the registered owner, the property details, mortgages, restrictions and other encumbrances; the buyer reads it against the seller’s identity and against the sale agreement.
Step 2: condominium title, permits and the title category
For an apartment, the law requires that condominium title (kat mülkiyeti) or a condominium easement (kat irtifakı) has been established before a purchase permit can be applied for under Law 35/2010, and selling without it is an offence. For two years from the decree’s entry into force, an application may instead be made with a building permit or a Planning Approval from the Town Planning Department where condominium title could not be established. The title category on the deed (Turkish, exchange or equivalent, allocation) and the pre-1974 history of the land belong in the same check; a later section sets out what the sources say about them. The sibling article on North Cyprus title deeds and how to check one treats the categories in detail.
Steps 3 and 4: reservation, sale agreement and stamp duty
A reservation is a contractual arrangement between the buyer and the seller or developer, and what carries legal weight is the sale agreement that is stamped and then registered. Before any money moves, the agreement should carry the full price and currency, the payment schedule, the unit and parcel identification, the delivery date for a building not yet finished, what happens to deposits if the permit is refused, and the allocation of taxes between the parties. UK Government guidance on buying in Cyprus lists payment plans that are not included in the contract among the recurring problems.
The agreement is stamped at the Tax Department (Gelir ve Vergi Dairesi). Under the consolidated Stamp Duty Law 19/1963, an agreement stating a sum of money is taxed at 0.5% of the sum up to TL 89,000,000 and 0.1% above that. The buyer pays the stamp on a sale agreement unless the parties agree otherwise, and an amount in foreign currency is converted at the official effective selling rate on the day of stamping, so a sterling price produces a stamp duty bill in lira.
Step 5: registration within one month and the permit application
This is the first hard deadline. Under the decree, the foreign buyer must register the stamped agreement at the district Land Registry (İlçe Tapu Amirliği), in person, through a lawyer or by proxy, within one month, after buyer and seller have paid the taxes and fees due on the sale. The application to the Ministry for the purchase permit must be made within the same period. The decree’s wording is that a contract not handled this way is void automatically. The official text requires registration at the Land Registry, not at a court.
The Interior Ministry’s Property Unit publishes a document list for the permit application: a petition (Annex 1 for an apartment, Annex 2 for a house, Annex 3 for land), information forms (Annexes 4 and 5), a copy of the passport or identity card, a copy of the title (koçan), a location plan with the area marked, the original police record from the applicant’s country, the sale contract if there is one, and a TL 45 stamp for applications made by proxy. Applications are accepted in person, by proxy or through a lawyer, and the Ministry also has an online portal. The application fee is half of the gross monthly minimum wage; with the gross wage of TL 70,893 valid from 1 July 2026, that is TL 35,446.50 (calculated: 70,893 divided by 2). Half of that fee goes to the compensation account of the Immovable Property Commission and the rest to the Land Registry.
Steps 6 and 7: security inquiry, decision and publication
The Ministry checks with other authorities whether the property is objectionable for military reasons, and the foreign applicant and any shareholders are vetted on the basis of their home-country police record and a security inquiry. Law 52/2008 sets no time limit for the Council of Ministers’ decision, so the interval between steps 5 and 7 has no statutory length. The permit is published in the Resmi Gazete, and the publication date starts the two transfer clocks.
Steps 8 and 9: fees and the transfer declaration
The transfer fees must be paid within 75 working days of publication (60 working days in the consolidated text), or the permit lapses. If the permit is cancelled for non-payment, a re-application costs double fees, and a third application for the same property is not allowed. The title is then transferred on the printed transfer declaration before the official at the district Land Registry within one year of publication under the decree (six months in the consolidated text). Where no mortgage is registered in the seller’s favour, the decree starts that period on the date the whole price stated in the document filed with the Ministry has been paid, which links the payment schedule in the sale agreement to the transfer deadline.
Step 10: utilities
Until all taxes and fees are paid, local authorities may not give a permanent or temporary water connection and the electricity authority may not give a temporary or permanent electricity connection. Site connections during construction are exempt. The practical effect is that a buyer taking possession of a completed home should have the fee receipts ready when applying for the meters.
A Worked Timeline for How to Buy Property in North Cyprus
The legal clocks can be turned into dates. The dates in the next table are illustrative: they assume that the permit is published on 15 March 2027, and they count working days as Monday to Friday without public holidays, which would push the end dates later. The one-month period before the permit application runs from the buyer’s own date of signing, so it is not given a calendar date here.
| Stage | Trigger | Deadline under Decree-Law 89/2026 | Deadline under the consolidated text |
|---|---|---|---|
| Council of Ministers decision | Complete file lodged | No period set in the law | No period set in the law |
| Pay transfer fees | Permit published, assumed 15 March 2027 | 75 working days: 28 June 2027 (calculated) | 60 working days: 7 June 2027 (calculated) |
| Sign the transfer declaration | Permit published, assumed 15 March 2027 | 1 year: 15 March 2028 | 6 months: 15 September 2027 |
Three conclusions follow from the table. First, the decision step is the one part of the timeline with no statutory length, and developers’ stated durations for it are the developers’ own statements: the developer Isatis, for example, states one to two months for Turkish citizens and six to eight months for other nationalities on its FAQ page, and the law does not set either figure. Second, the two deadlines are separate: under the decree the fees must be paid by 28 June 2027 in the example even though the transfer declaration may be signed as late as 15 March 2028, while the consolidated text shortens both. Third, the choice between the two columns depends on whether the decree is in force or has been enacted on the date the permit is published, which is why the lawyer’s file note should record that date.
What a Purchase Costs: A Worked Example in Pounds Sterling
Any plan for how to buy property in North Cyprus needs a cost estimate, and costs are easiest to follow with a number. The example uses GBP 220,000, which is the start price shown on our listing page for the 1+1 at Natulux Tatlisu and the lower bound of the 2+1 range on our Grande Palazzo page. It treats the home as the buyer’s first property, with a closed area under 300 m2. Nothing here is a quote: the listing pages do not say whether their prices include VAT, so the VAT line is shown as a possible addition.
| Item | Rule | Calculation on GBP 220,000 |
|---|---|---|
| Land Registry fee, first property | 4% in total: 3% transfer, 0.5% Immovable Property Commission, 0.5% Housing Acquisition Unit | GBP 8,800 (6,600 + 1,100 + 1,100) |
| Land Registry fee, second property | 5.5% (4% + 1% + 0.5%) | GBP 12,100 |
| Land Registry fee, third property | 6% (5% + 1%) | GBP 13,200 |
| Stamp duty on the agreement | 0.5% of the sum; converted to lira at the official effective selling rate on the day of stamping | GBP 1,100 equivalent |
| VAT on a new home | 5% up to 300 m2 of closed area; 10% from 300 m2; resale treatment not stated in the regulation | GBP 11,000 at 5%, if VAT applies and is not already in the price |
| Purchase-permit application | Half of the gross monthly minimum wage | TL 35,446.50 |
| Mortgage registration, if a loan is taken | 1% of the loan amount registered, paid by the mortgagor | GBP 1,000 on a GBP 100,000 loan |
| Lawyer, notary, connection fees | No official tariff | Not computed |
The fee schedule is a Council of Ministers regulation published in Resmi Gazete No. 197 on 7 October 2026, valid from publication until 5 January 2027 inclusive. For nationals of states that recognise the TRNC the same schedule charges 4% on the first two properties, 5.5% on the third and fourth, and 6% on the fifth and sixth. The law says that taxes, duties and fees on a transfer are paid by buyer and seller according to the legislation in force, and the fee schedule says the registration fee is paid by the person registering title in their own name. Percentages of 6%, 9% and 12% appear on some agency pages; they predate the 7 October schedule. The 5% VAT rate comes from the regulation on VAT rates updated on 7 October 2026, which places “all immovable property and housing with closed area up to 300 m2, furnished or not” in the 5% schedule and housing of 300 m2 or more in the 10% schedule. The regulation itself does not say which resales fall inside VAT.
The full cost of a purchase therefore has a fixed core that can be calculated from the contract price (the Land Registry fee and the stamp duty) and a variable layer that cannot: VAT depending on how the price is quoted, the lawyer’s fee, connection charges, and the currency effect of paying lira-denominated duties out of a sterling budget. The sibling article on North Cyprus property prices by town explains how to read the price fields that these examples start from.
Payment Plans: Reading a Schedule Before Signing
Developer instalment plans are a common way to pay for a home that is not finished, and an agency guide to financing describes them as dominating the off-plan market. The schedules differ by project, so the useful skill is turning the percentages into amounts and dates. Our Grande Palazzo listing page shows three options, and the table converts them on the GBP 220,000 start price of the 2+1.
| Option per our listing page | Terms as shown | Amounts on GBP 220,000 (calculated) |
|---|---|---|
| 1 | 35% down payment, 35% before receiving the keys, 30% after receiving the keys (24 months) | GBP 77,000 + GBP 77,000 + GBP 66,000 |
| 2 | 50% down payment and 50% before receiving the keys, with 5 home appliances as a gift | GBP 110,000 + GBP 110,000 |
| 3 | 100% payment within 3 to 6 months with a 5% discount | GBP 209,000 (220,000 x 0.95), a difference of GBP 11,000 |
Three points connect such a schedule to the legal sequence. The first is the one-month rule: the stamped agreement must be registered and the permit applied for within a month of signing, so the schedule in the agreement is the schedule that will be filed. The second is the transfer clock: under the decree, where no mortgage is registered in the seller’s favour, the one-year transfer period starts when the whole price stated in the filed document has been paid, so a plan that runs for 24 months after the keys sits uneasily beside a clock that starts only on full payment, and the contract should say how the parties will handle it. The third is the developer’s own finance: UK Government guidance names developer mortgages on the land among the problems it has seen in Cyprus, and the ownership search of step 1 is where such a mortgage appears.
A bank loan is the alternative. Law 52/2008 allows foreigners to mortgage property they have acquired after paying the Land Registry fees, and to be a mortgage holder. The registration fee is 1% of the debt registered. Lending terms for foreign buyers are set by each bank, and agency pages differ widely on them, so the bank’s own offer is the only reliable statement of a loan-to-value ratio or a rate.
How to Buy Property in North Cyprus Off-Plan Versus Completed
The ten steps of how to buy property in North Cyprus apply to both, but the evidence the buyer holds and the risks that matter change with the building’s stage. Our listing pages show both kinds. Panorama Iskele and Sky Sakarya in Famagusta are listed as delivered projects with “resale asks from” prices, which are sellers’ asking prices and not developer prices. Natulux Tatlisu and La Casalia Tatlisu are listed as ongoing developments with delivery dates in May 2027 and December 2027 per the developer.
| Topic | Completed home or resale | Off-plan home |
|---|---|---|
| What the buyer can inspect | The finished unit, its meters and its common areas | Plans, the permit file and the site |
| Condominium title or easement | Should exist before the permit application; check it in the search | Same rule: a condominium easement or title must exist for the unit before the permit application |
| Final approval | Statistics count only buildings with a final approval certificate (nihai tasvip); ask whether the certificate exists | Not yet issued; the contract should tie handover to it |
| Payment | As written in the sale agreement | As written in the sale agreement, which may run over the build and after handover |
| Transfer clock | Starts at publication, or at full payment if no mortgage is registered for the seller | Same rule, so full payment may come only after handover |
| Utilities | Connection in the buyer’s name needs paid taxes and fees | Site connections during construction are exempt; permanent connections follow payment of fees |
| Principal risks named by official guidance | Pre-1974 claims on the land; mortgages and restrictions shown in the search | Late completion certificates and title deeds, payment plans left out of the contract, developer mortgages on the land |
| Delivery date in our examples | Panorama Iskele: June 2023; Sky Sakarya: May 2023; Four Seasons Life II: July 2024 (per the developer) | Natulux Tatlisu: May 2027; La Casalia Tatlisu: December 2027 (per the developer) |
For an off-plan home, the practical difference is that the buyer is paying for a building that does not yet exist. The UK Government guidance names difficulty in obtaining final completion certificates and title deeds as a recurring problem in Cyprus, so the sale agreement is where the delivery date, the consequences of delay and the obligation to deliver a separate title belong. The sibling article on buying off-plan in North Cyprus develops that contract analysis. For a resale, the central evidence is the search of step 1 and the title category on the deed; resale prices on our pages are asking prices, and the actual price is whatever the sale agreement states.
Our Listings Compared: What the Pages Show Before the Process Starts
The table sets out seven Northern Cyprus listings that illustrate the cases above. Prices are as shown on each listing page when checked on 24 October 2026; “starting from” is a minimum for one unit type and “resale asks from” is a seller’s figure. The columns say what each figure is, because the ten steps above start from the sale agreement, and the agreement’s price is the number that counts.
| Listing | Stage | Price per our listing page | Delivery per the developer | Payment terms on the page |
|---|---|---|---|---|
| Panorama Iskele | Completed; studio to 3+1 | Resale asks from GBP 110,000 | June 2023 | None shown |
| Sky Sakarya Famagusta | Completed; 1+1 and 2+1 | Resale asks from GBP 63,500 | May 2023 | None shown |
| Four Seasons Life II Iskele | Delivered; 1+1 loft | Starting from GBP 160,000 (developer, 18 October 2026) | July 2024 | None shown |
| Natulux Tatlisu | Ongoing; 97 units, 1+1 to triplex | Starting from GBP 220,000 for the 52 m2 1+1 | May 2027 | None shown |
| La Casalia Tatlisu | Under construction; 454 units | Starting from GBP 178,000 for the 47 m2 Grand Studio | December 2027 | None shown |
| Grande Palazzo Iskele | Year built 2026 per the page | GBP 220,000 to GBP 570,000 across apartments and villas | Not stated | Three options: 35/35/30, 50/50, or 100% with a 5% discount |
| Bellagio Iskele | Pre-sale label; 281 units | On request | Not displayed | None shown |
A figure on a listing page and the price in the sale agreement are separate things. A “from” price covers the cheapest unit, a “resale asks” price is a seller’s request, and “on request” means there is no number to compare. None of the pages states whether VAT is included, and none replaces the title search, the permit file or the contract. Buyers who want to place these projects geographically can use the pages for the Famagusta and Esentepe areas, and the overview of the Northern Cyprus market lists every project. A town-by-town view is in the guide to the main areas for buying in North Cyprus.
Title Deeds and Due Diligence: What to Check Before the One-Month Clock
Because the clock in step 5 starts at signing, the checks belong before signing. The title question is the one that listing pages cannot answer. Article 159 of the TRNC Constitution vests in the State immovable property found abandoned on 13 February 1975 or classified by law as abandoned or ownerless afterwards, and says that persons claiming legitimate rights in it can prove them under a procedure and compensation basis set by law. A separate provision reserves the right of TRNC citizens who left property in the south to ask for property of equivalent value, which is the constitutional basis of the equivalent or exchange system. The Land Registry’s fee schedule confirms that the register distinguishes land registered with a Final Disposition Certificate (Kesin Tasarruf Belgesi) from points held under Value Documents (Mal Değer Belgeleri). Terms such as Turkish title, exchange title and allocation are used in agency guidance, and the deed and an official search are the evidence of which category applies.
The wider legal context is documented by official sources. UK Government guidance on buying property in Cyprus states that ownership of many properties in the north is disputed, that thousands of claims come from people displaced in 1974, and that the European Court of Human Rights has treated pre-1974 owners as continuing legal owners. In its admissibility decision of 1 March 2010 in Demopoulos and Others v. Turkey, the Court held that the Immovable Property Commission set up under Law 67/2005 offers an effective remedy for Greek Cypriot property claims. The Commission’s site describes its work on restitution, compensation and exchange, and Law 67/2005 allows applications until 21 December 2027. In Apostolides v Orams (28 April 2009), the Court of Justice of the EU held that a judgment of a Republic of Cyprus court ordering buyers to vacate land in the north must be recognised and enforced in other member states, as the Court’s press release records. The UK guidance adds that a Republic of Cyprus criminal-law amendment in force since 20 October 2006 makes buying, selling or mortgaging property without the registered owner’s permission an offence, and a Cyprus Mail report of 15 September 2025 quoted the Republic’s chief negotiator on arrests of EU and third-country nationals suspected of developing Greek Cypriot-owned land in the north. That report states the Greek Cypriot side’s position. The fuller treatment of these risks is in the sibling article on pre-1974 claims and other risks of buying in North Cyprus.
One more location rule applies in Famagusta. The UN Security Council’s resolutions 550 (1984) and 789 (1992) and its presidential statement of July 2021 say that settlement of any part of Varosha by people other than its inhabitants is inadmissible, and the Secretary-General’s report S/2026/550 of 6 July 2026 records that no step was taken to reverse the October 2020 measures. A buyer of any Famagusta property should confirm from the parcel details whether it lies in the Varosha area.
Documents Checklist for How to Buy Property in North Cyprus
The checklist combines the Interior Ministry’s list, the Land Registry notices and the due-diligence points in the UK guidance. Each row is a document or a registry search, not a statement from a seller.
| Document | Issued by or filed with | Why it matters |
|---|---|---|
| Passport or identity card copy | Buyer; filed with the Interior Ministry | Identifies the applicant for the permit |
| Police record from the home country (original) | Home-country authority; filed with the Interior Ministry | Basis of the security inquiry; the decree keeps a 3-month age limit and apostille for applications by licensed intermediaries |
| Ownership search (araştırma belgesi) | District Tapu Amirliği | Shows registered owner, mortgages and restrictions |
| Copy of the title (koçan) | Seller; filed with the application | Shows the title category and parcel |
| Condominium title or easement record | Land Registry | Required before the permit application for an apartment |
| Building permit and, for a completed building, final approval | Local authority and Town Planning Department | Evidence the building is lawful and complete |
| Location plan with the area marked | Buyer or lawyer; filed with the application | Allows the military-zone and area checks |
| Stamped sale agreement | Tax Department stamp; registered at the Land Registry | Starts the one-month and payment clocks |
| Petition and information forms (Annexes 1 to 5) | Interior Ministry forms | The application itself |
| Fee receipts | Land Registry and Tax Department | Needed for the transfer and for utility connections |
| Power of attorney, if the buyer is abroad | Buyer; a TL 45 stamp applies to an application by proxy | Allows a lawyer to act at the offices |
The independent lawyer matters more than any single document. The UK guidance lists lawyers acting for both vendor and builder among the recurring problems and notes that there is a separate bar association for each district in the north (Nicosia, Kyrenia, Famagusta and Morphou), under the Cyprus Turkish Bar Association. No official TRNC tariff for legal or notary fees was found, so any fee is a matter for agreement with the lawyer.
Money, Currency and Transfers
Most prices on our listing pages are in pounds sterling, while the TRNC’s legal tender is the lira. The Statistical Institute reported that the TRNC consumer price index rose 35.02% over the twelve months to September 2026 (3.34% in the month and 28.15% since December 2025). A contract in sterling or euros avoids lira exposure on the price, while the stamp duty, the permit fee and any payment to a local contractor are calculated in lira.
The Foreign Exchange Law 38/1997 makes holding foreign currency, using it as a means of exchange and expressing contract amounts in foreign currency free. Remittances in and out are free provided banks are used and the names and addresses of sender and recipient are recorded, with total amounts reported to the Central Bank. No special exchange-control rule for property buyers was found. The Financial Transactions Tax Law 62/2026, in force from 1 October 2026, replaces the earlier bank and insurance transactions tax: it sets 0.1% of the foreign-currency sale amount on exchange transactions, 1% on interbank deposit transactions, 5% on insurance premiums and 3% on other receipts, collected by financial institutions from customers, with the Council of Ministers able to lower the rates.
After the Title Is Registered: Taxes, Residence and Letting
Ownership brings annual and event-based obligations. The annual immovable property tax is set by a regulation; the latest schedule found on the Tax Department site took effect on 1 January 2025. For housing of normal reinforced-concrete construction it sets a base of TL 6.60 per m2 up to 120 m2 and TL 7.15 per m2 above 120 m2, with surcharges of 10%, 25%, 40% or 60% by the property’s category and TL 35.60 per m2 for a swimming pool. A 76 m2 apartment, the size shown for the 2+1 at Natulux Tatlisu, has a base of TL 501.60 (calculated: 76 x 6.60) before surcharges. Rental income is subject to 10% withholding on gross rent under the Income Tax Law, and a tourism let of up to 60 days of a unit built as housing falls under the Holiday Houses Law, which requires registration with the Tourism Planning Department and an operating permit before letting. The sibling guide on renting out property in North Cyprus covers the letting rules.
On a later sale, the Income Tax Law treats the net gain of a seller who is not a property dealer as 20% of the higher of the Land Registry’s assessed value and the sale price, exempts 30% of that gain, and has the Land Registry withhold 20% of the remainder as a final tax. The effective rate is 2.8% of the value (calculated: 20% x 70% x 20%). The one-off exemption for a house or plot acquired after 1 January 1982 is not available to foreigners.
Residence is a separate process from the purchase. Under the Residence and Visa Regulation (text of 5 October 2026), an owner may apply for a property-based short-term residence permit if the home is suitable for residence and used for it. With a purchase by contract, at least one-third of the price must be paid and the purchase-permit application lodged. With title in the applicant’s name and property worth GBP 300,000 or more, the permit runs 10 years without an income test, and below that 5 years; with only a stamped and approved sale contract, GBP 300,000 or more gives 5 years without an income test, and below that proof of monthly income of one minimum wage is required. Permanent residence under Law 51/2015 needs housing worth at least EUR 125,000, proven income, six years of continuous permits (three at age 60 or over), health insurance and a clean record. A purchase does not give TRNC citizenship, which under the Citizenship Law 25/1993 needs five years of uninterrupted residence or a Council of Ministers decision for investors. The European Commission records that EU legislation is suspended in the north under Protocol 10 to the 2003 Act of Accession, and UK travel advice states that the Republic of Cyprus does not recognise residence permits issued in the north. The articles on the residency programme and on citizenship and immigration give the background.
Common Mistakes When Buying in North Cyprus
The rules above make some errors predictable for anyone learning how to buy property in North Cyprus. The list follows the order in which they tend to occur.
- Quoting an outdated limit. “One property” is the text of the consolidated Law 52/2008. The decree allows more while it is in force, and it may lapse about 5 November 2026 unless Parliament enacts it.
- Using an old fee figure. The 7 October 2026 schedule gives 4%, 5.5% and 6% to 5 January 2027. Figures of 6%, 9% and 12% on agency pages predate it.
- Missing the one-month deadline. A stamped agreement not registered, with the permit applied for, within a month is void automatically under the decree.
- Treating a listing price as the contract price. A “from” price, a “resale asks” price and “on request” are three different things, and the listing pages do not state VAT.
- Leaving the payment plan outside the contract. UK Government guidance names this among the problems it has seen; the schedule filed with the Ministry also drives the transfer clock.
- Skipping the ownership search. The search is the source for the registered owner, mortgages and restrictions; a listing page cannot clear title.
- Assuming the lawyer is independent. The UK guidance lists a lawyer acting for both vendor and builder as a recurring problem.
- Forgetting the fee deadline. The permit lapses if fees are not paid within 75 working days (60 in the consolidated text); a second application costs double fees, and a third is not allowed.
- Reading residence as citizenship. A property-based residence permit runs 5 or 10 years, and a purchase does not give citizenship, EU rights or a residence permit the Republic of Cyprus recognises.
- Counting on a utility connection before fees are paid. Permanent water and electricity connections wait for payment of all taxes and fees.
Frequently Asked Questions
What is the first step in how to buy property in North Cyprus?
In how to buy property in North Cyprus, the first step is an ownership search at the Tapu Amirliği of the district where the property lies, together with a check that condominium title or easement exists for the unit. These come before the sale agreement because the one-month deadline to register the agreement and apply for the permit starts at signing.
Do foreigners need permission to buy property in North Cyprus?
Yes. Law 52/2008 requires a Council of Ministers purchase permit, applied for through the Interior Ministry. The limits in force as of 24 October 2026 come from Decree-Law 89/2026, which allows up to three apartments or the land and house options set out above, and which depends on the decree remaining in force or being enacted.
How long does the permit take?
The law sets no time limit for the Council of Ministers’ decision. Durations quoted by developers are their own statements. After the permit is published, the buyer has 75 working days to pay fees and one year to sign the transfer under the decree, or 60 working days and six months under the consolidated text.
What are the Land Registry fees when you buy property in North Cyprus?
For foreign buyers the schedule of 7 October 2026 is 4% for the first property, 5.5% for the second and 6% for the third, valid to 5 January 2027. On GBP 220,000 the first-property fee is GBP 8,800. Stamp duty of 0.5% on the agreement and VAT, where it applies, are additional.
Is VAT charged when you buy property in North Cyprus?
The regulation of 7 October 2026 puts housing up to 300 m2 of closed area in the 5% schedule and housing of 300 m2 or more in the 10% schedule. It does not itself say which resales are inside VAT, and our listing pages do not state whether their prices include it, so the sale agreement should state it.
Can a buyer pay in instalments?
Developer instalment plans exist, and the Grande Palazzo page shows three options, including 35% down, 35% before the keys and 30% over 24 months after. The schedule is part of the filed contract, and under the decree it can also set the start of the one-year transfer period.
Can a buyer take a mortgage?
Law 52/2008 lets foreigners mortgage property they have acquired after paying the Land Registry fees, and registration costs 1% of the debt registered. Loan-to-value and interest rates are set by each bank and are not fixed by the law.
Does buying give residence or citizenship?
No purchase gives either automatically. A property-based residence permit of 5 or 10 years is available on stated conditions, such as a GBP 300,000 threshold for the 10-year permit with title, and TRNC citizenship needs five years of residence or a Council of Ministers decision. EU rights do not follow.
Can a seller or a listing page clear the title?
No. Title status is specific to the parcel and shown by the deed and an official search. Official sources document pre-1974 ownership claims, the Immovable Property Commission and the Orams judgment, which is why the title check comes before signing for anyone planning how to buy property in North Cyprus.
What changes after 5 November 2026 and 5 January 2027?
Decree-Law 89/2026 has a 90-day validity that ends about 5 November 2026 unless Parliament enacts it, and the fee schedule of 7 October 2026 is valid to 5 January 2027. A buyer should check both dates against the Resmi Gazete before signing.
